These Terms govern your use of obsurvive.com (the "Site"), operated by Obsurvive, Inc. ("we," "us"). By using the Site you agree to these Terms.
1. The Site
The Site provides information about Obsurvive and the products we build and operate. Our products (such as Journzy and Fairly) are offered under their own separate terms and privacy policies, which govern your use of them.
2. Acceptable use
You agree not to misuse the Site, interfere with its operation, attempt unauthorized access, or use it unlawfully.
3. Intellectual property
All content and materials, including text, design, graphics, logos, and trademarks, are owned by Obsurvive, Inc. or its licensors. We grant you a limited, revocable, non-exclusive right to view the Site for personal, informational use. No other rights are granted.
4. No warranties
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
5. Limitation of liability
To the maximum extent permitted by law, Obsurvive will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill, arising from your use of the Site.
6. Mandatory consumer rights
Nothing in these Terms limits rights you have under mandatory consumer-protection law that cannot be waived (including under EU, UK, Canadian, or Quebec law where it applies to you). Where a provision conflicts with such law, that law prevails and the rest of these Terms remain in effect.
7. Changes
We may modify, suspend, or discontinue the Site and update these Terms at any time. Continued use after changes means you accept them.
8. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules, subject to Section 6, and except where mandatory local law gives you the right to your local courts and law.
